Prohibition of waiting order: Chester - Boughton Service Road

Cheshire West and Chester Council (“the Council”) in exercise of its powers conferred by Sections 1, 2, 4 and 124 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (hereinafter referred to as “the 1984 Act”), Part 6 of the Traffic Management Act 2004 and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act hereby makes the following Order:-
  1. This Order shall come into operation on the 22nd of March 2021 and may be cited as the “Cheshire West and Chester Borough Council (Boughton Service Road, Chester) (Prohibition of Waiting) Order 2021”. 
  2. The Cheshire West and Chester Borough Council (Prohibition and Restriction of Waiting and Street Parking Places) (Civil Parking Enforcement and Consolidation) Order 2013 (“the 2013 Order”) is hereby amended by the addition of the prohibitions of waiting shown on attached plans (tile reference CS40/A, on length of Boughton Service Road to those depicted on the corresponding lengths on the relevant plans (tile references CS40) attached to the 2013 Order. All other restrictions shown on the said plans attached to the 2013 Order shall continue in full force and effect.

Notice is hereby given that on the 16th March 2021 Cheshire West and Chester Borough Council made the following Traffic Regulation Order in accordance with the provisions of the Road Traffic Regulation Act 1984 which will come into effect on 22nd March 2021.
THE CHESHIRE WEST AND CHESTER BOROUGH COUNCIL
(BOUGHTON SERVICE ROAD, CHESTER)
(PROHIBITION OF WAITING) ORDER 2021

The effect of the Order will be to prohibit waiting on Boughton Service Road (north side) from its westerly end for a distance of 28 metres in an easterly direction. 

Any person who desires to question the validity of the Orders or of any provision therein on the ground that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the ground that any requirement of that Act or any regulation made thereunder has not been complied with in relation to the Order may within six weeks from 16 March 2021 make application to the High Court for this purpose.
