Experimental order: Chester - electric scooter trial
|The Cheshire West and Chester Borough Council (“the Council”) in exercise of its powers under sections 9, 10 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984 (“the 1984 Act”) and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act hereby makes the following Order:-|
1. This Order will come into operation on the 21st day of December 2020 and may be cited as the Cheshire West and Chester Borough Council (Electric Scooter Trial, Chester) (Experimental) Order 2020.
2. In this Order-
“cycle lane” means part of a carriageway of a road reserved for pedal cycles and electric scooters that is separated from the rest of the carriageway.
“cycle track” means a way constituting or comprised in a highway, being a way over which the public have the following, but no other, rights of way, that is to say, a right of way on pedal cycles with or without a right of way on foot;
“electric scooter” means an electric scooter as defined in The Electric Scooter Trials and Traffic Signs (Coronavirus) Regulations and General Directions 2020 hired from a company authorised by the Department for Transport for the purpose of operating electric scooters within the electric scooter trial area.
“electric scooter trial area” means the lengths of carriageways and cycle tracks within the operating area for electric scooters in Chester as shown on the attached plan.
“pedal cycle” means a unicycle, bicycle, tricycle or cycle having four or more wheels, not being in any case mechanically propelled unless it is an electrically assisted pedal cycle of such a class as is to be treated as not a motor vehicle for the purposes of the 1984 Act;
3. While this Order is in force, the traffic regulation orders having effect within the electric scooter trial area that include exemptions for pedal cycles are hereby varied to include the same exemptions for electric scooters.
4. While this Order is in force, all existing cycle tracks within the electric scooter trial area are hereby redesignated as cycle lanes.
5. The Council’s Senior Manager for Highways and Transport may, after consultation with the Chief Officer of Police, modify or suspend the operation of the Order or any provision of it if it appears to him essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order runs.
