Street parking places order: Chester - The Groves

Public notice

Notice is hereby given that the Cheshire West and Chester Borough Council propose to make the following Traffic Regulation Order in accordance with the provisions of the Road Traffic Regulation Act 1984.

The effect of the Order will be to reconfigure a 22 metre length of existing parking bay at The Groves, which is currently reserved for motorcycles at weekends and bank holidays.  This length is located between 176 metres and 198 metres north east of its junction with Bridge Street.  One length of 5.5 metres will be reserved for motorcycles at all times.  The other length of 16.5 metres will be reserved for motorcycles at weekends and bank holidays from March to October.  From November to February it will be available for other vehicles.  In all cases parking is permitted for one hour with no return within one hour and the restrictions in the general parking length will apply from 8am to 6pm.

Statement of reasons

In August 2020 a section of The Groves between Souters Lane and the Bridge Street was converted to make four of the parking bays for motorcycle use only at weekends and on bank holidays.

Monitoring of the usage and discussion with motorcyclists has shown that there is very little use of the bays through the winter months when weather discourages motorcycle use and that other vehicles have been using the bays at the times when they are dedicated to motorcycles.

It is therefore proposed that one of the four bays converted be changed to be a dedicated motor cycle bay at all times to enable it to be clearly marked and give provision at all times and that the remaining length be changed to only be dedicated for motor cycles at weekends and bank holidays during the summer months when there is expected to be more use.

Parking would continue to be restricted to one hour to generate a turnover and increase the opportunities of finding a parking space.

Hopefully this will provide an acceptable balance in the parking facilities in this area

Decision notice

Cheshire West and Chester Borough Council has made the decision that public notice be given of the Council’s intention to make an Order the effect of which will be to:
  • Restrict parking to motorcycles only for 1 hour and no return within 1 hour on The Groves (south-east side) from a point 192.5 metres north-east of its junction with Lower Bridge Street for a distance of 5.5 metres in a north-easterly direction.
  • Restrict parking from 1 November to 28 February (or 29 February in leap years) between 8am and 6pm to 1 hour and no return within 1 hour on The Groves (south-east side) from a point 176 metres north-east of its junction with Lower Bridge Street for a distance of 16.5 metres in a north-easterly direction.
  • Restrict parking from 1 March to 31 October on Monday to Friday (excluding bank holidays) between 8am and 6pm to 1 hour and no return within 1 hour on The Groves (south-east side) from a point 176 metres north-east of its junction with Lower Bridge Street for a distance of 16.5 metres in a north-easterly direction.
  • Restrict parking to motorcycles only from 1 March to 31 October on Saturdays and Sundays and bank holidays between 8am and 6pm for 1 hour and no return within 1 hour on The Groves (south-east side) from a point 176 metres north-east of its junction with Lower Bridge Street for a distance of 16.5 metres in a north-easterly direction .
Reasons for the decision
  • To provide an acceptable balance in the parking facilities in this area by converting one of the four bays to be a dedicated motor cycle bay at all times to enable it to be clearly marked and give provision at all times and that the remaining length be changed to only be dedicated for motor cycles at weekends and bank holidays during the summer months when there is expected to be more use.

Draft order

Cheshire West and Chester Borough Council (“the Council”) in exercise of its powers conferred by Sections 1, 2, 4, 32, 35 and 124 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (hereinafter referred to as “the 1984 Act”), Part 6 of the Traffic Management Act 2004 and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act hereby makes the following Order:-

1.    This Order shall come into operation on the xxth day of xxx 2021 and may be cited as the “Cheshire West and Chester Borough Council (The Groves, Chester) (Street Parking Places) Order 2021”. 

2.    The Cheshire West and Chester Borough Council (Prohibition and Restriction of Waiting and Street Parking Places) (Civil Parking Enforcement and Consolidation) Order 2013 (“the 2013 Order”) is hereby amended by the substitution of the parking bay and restrictions of waiting shown on attached plan (tile reference CU38/A on lengths of The Groves, Chester for those depicted on the corresponding lengths on the relevant plan (tile reference CU38) attached to the 2013 Order.  All other restrictions shown on the said plan attached to the 2013 Order shall continue in full force and effect.
