Winsford man fined for potential domestic waste health hazard

A Winsford man has been fined for leaving piles of domestic waste outside his property creating a potential health hazard.

Darren John Miles, 46, of Windsor Drive, was charged with failure to comply with an abatement notice under Section 80 of the Environmental Protection Act 1990. He failed to appear at West Cheshire Magistrates’ Court for the hearing last Thursday (May 19) and the case was proved in his absence.

The court heard that the Council initially received a complaint about piles of domestic waste outside the property in Winsford in March 2015. Council officers visited to assess the situation and then wrote the owner of the property requesting that the bags of rubbish be removed.

A follow-up visit found that conditions had not improved and piles of domestic waste in black bin liners were still outside the property, as well as dog faeces. An abatement notice was issued and the most dangerous, vermin-attracting waste was removed.

However, future visits showed that black bin liners of domestic waste had again started to accumulate around the property. On 23 October a total of 16 bags were removed by Council officers from the front and side of the property.

Mr Miles was fined a total of £809. His fine was £202 and he was also ordered to pay investigation costs of £482, prosecution costs of £85 and a victim surcharge of £22.

Councillor Karen Shore, Cabinet Member for Environment, said: "Incorrect storage or disposal of domestic waste may cause flies and odours from rotting food waste and may attract vermin. We have no hesitation in taking robust action against anyone found responsible for creating a potential risk to health in our communities."
